Terms of Service | FiveBack

1. Service Description

FiveBack (“we”, “us”, “our”) provides an AI-powered review response management platform accessible at fiveback.co. The service generates suggested responses to Google Business Profile reviews, which you review and approve before they are posted on your behalf.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into this agreement. You must have authorization to manage the Google Business Profile you connect. By using FiveBack, you represent that you meet these requirements.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@fiveback.co if you suspect unauthorized access.

4. Google Business Profile Access

By connecting your Google account, you authorize FiveBack to read your business reviews and post responses that you have explicitly approved. We only access the permissions you grant through Google's OAuth consent flow. You can revoke access at any time through your Google account settings at myaccount.google.com/permissions.

5. AI-Generated Content

Responses are generated by artificial intelligence and presented as suggestions only. You are solely responsible for reviewing, editing, and approving all responses before they are posted. Once you approve a response, it becomes your content and you assume full responsibility for it. We do not guarantee that AI-generated responses will be appropriate, accurate, or suitable for every situation.

6. Billing and Subscription

FiveBack is billed at $49 per month per business location through our payment processor, LemonSqueezy. Your subscription renews automatically each month until cancelled. You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you will not be charged again. See our Refund Policy for details on refunds. All prices are in USD.

7. Acceptable Use

You agree not to use FiveBack to post defamatory, misleading, or illegal content in review responses. You will not use the service to spam, harass, or deceive consumers. You will not attempt to reverse-engineer, copy, or resell the service. We reserve the right to suspend or terminate accounts that violate these terms without refund.

8. Service Availability

We aim to keep FiveBack available at all times but do not guarantee uninterrupted access. The service depends on third-party APIs (Google, Anthropic) that may experience downtime outside our control. We are not liable for service interruptions caused by third parties.

9. Limitation of Liability

FiveBack is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability is limited to the fees you paid us in the 3 months preceding any claim.

10. Indemnification

You agree to indemnify and hold FiveBack harmless from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or content posted through your account.

11. Dispute Resolution

Any disputes arising from these terms or your use of FiveBack will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. You agree to waive any right to participate in a class action. For claims under $500, either party may pursue resolution in small claims court.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.

13. Termination

Either party may terminate this agreement at any time. Upon cancellation, your subscription remains active until the end of the current billing period. We may suspend or terminate accounts that violate these terms immediately and without notice. Upon termination, your right to use the service ceases and we may delete your data after 30 days.

14. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
